Class-action lawsuit?

Some reading of review sites and blogs indicates that the thieves at McMahon's RV have illegally frauded 10s of customers, and it is likely that there are many more not posting their experiences to the web. It would be nice to accumulate a collection of such injustices in one place, and to consider the possibility of a class-action suit. I am not a legal expert, so I am not sure if that is possible here (for instance, are the complaints to varied?). Any opinion on that matter, here, would be helpful. Also, anyone seeking legal justice against these crooks could be indicated here, and we can determine if collective action is beneficial/warranted.

  3. Probably sold only the assets to Camping World and the debts will likely be wiped clean in a BK filing by Mega RV and/or Brent McMahon.

  5. Yeah, I am sure they will file for bankruptcy. I wonder if that indemnifies them of financial liability that is the result of criminal wrong doing, tho. Like if they take your cash, sign a document saying they'll give you an RV, and they just flat out rip you off...that is a crime. I can't imagine filling bankruptcy will let Brent of the hook for that sort of nefarious behavior. Am I wrong here? Does anyone know?

  7. We too have been defrauded by McMahon's. We paid $2400 for a new stackable washer and dryer to be installed in our brand new 36' Holiday Rambler Ambassador motorhome. We later had problems with the washer within the first 9 months (so it should still have been under warranty) and called the manufacturer. They told us that our specific washing machine was no longer under warranty... WHY, you ask. McMahon's installed that particular washing machine in a gentleman's RV back in January 2013. That guy brought the RV back 3 months later because it quit working... so they put in a new washing machine from the manufacturer. Then in April 2013, they installed the same bad washer in our new RV and pretended it was NEW... knowing that it would NOT be covered under the warranty from the manufacturer!!! This is only ONE of the problems we had in the first 4 months! They didn't pay off our trade until we harassed, harassed and harassed them for 5 months!!!! We also had steering issues and had to stay a week in Oxnard, CA (we were on a cross country trip - because we live in Georgia) and the Sales Manager told us that they would repay our week long stay at the motel and a portion of our eating expenses... do you think we ever saw that money - NO!!! The response was the same every time... the check is in the mail - we promise! I don't think we are in the worst position possible from other's stories, but we would definitely be interested in getting involved in a class action lawsuit. We don't know that law, so not much help there.

  8. I am sorry for your ordeal, Buffy--yet another McMahon's horror story.

    Please check back here over the next few weeks if you can. IF we can rally a critical mass of people who would be willing to seek collective legal retribution in the form of a class-action lawsuit, I will gather some names and consult a qualified California auto fraud lawyer.

    1. Yes I would be interested in class action suit. We are going to small claims court in July. We may get a judgement but never see our money or the trade in again.

  10. On 4/6/14 we purchased a Jayco Class C from McMahon's RV Colton. We signed the sales contract and provided our debit card information for our deposit of $1,000. We were supposed to pick up our RV on 4/12/14 however that never happened! We received a call from our sales representative informing us that McMahons went out of business and we are able to get more information on rvbusiness.com for updates.

  11. I hate to say this but be thankful you "only" lost $1,000. I think someone else posted that they had paid for a rig in full and were waiting for it to be manufactured.

  12. Should have went to Mike Thompson RV, they are the #1 dealer in Southern California for a reason!!! No money problems, no bad debts, service first, top notch salespersons, fast trade payoff, greatest products around, and the best warranty options around.

  13. I'd be interested in joining in on a class action suit. I traded in my motorhome in Dec for a new one and not only have they not paid off the trade in but the sold my old coach to someone else. I don't have the money to pay for a coach I no longer have so now my credit is going to go down the toilet.

  14. In comparison, our problem is quite small. A year ago we purchased a Winnebago View from them. We traded in our Navion which was sold within hours. However, the finance manager, some tight-fisted guy from the Netherlands, did not pay off our trade for several weeks leaving us with two payments. Their service department stunk....should call is a dis-service department. Like others, we should have gone back to Mike Thompsons, but they repeatedly told us they would not order anything with bunk beds. Seemed silly, but they were adamant.

  15. Nobody will take a class action against what will soon be a bankrupt or asset-less defendant. You could go after BM as an individual, I guess, but it's hard to squeeze blood out of a turnip. Was the tightfisted Dutch guy named Paul Schilperoort?

  16. I would very much like to take part in a class action suit! We bought in Jan. 2014. Thankfully, we finally took delivery prior to their
    closing. However, we still don't know if the extended warranty we paid big bucks for is going to be valid, because they didnt register, nor I doubt paid for! We have fixed some minor issues ourselves and are working with the manufacturer on getting a larger issue fixed at another dealership. It's been a horrible experience and I'd sure like to see them held accountable! Brent McMahon should also be put on trial and convicted for committing fraud, among other questionable activities! I will keep checking this blog for more posts from other victims. It's hard to see a bright spot in this situation, but we are at least lucky enough having received our DMV registration and pink slip prior to their "lock up"! I feel horrible for others out there being stuck with payments for an RV they don't even have.

    1. I picked up my rv on a saturday and two days later the business was closed. I havn't received my tags yet and they didn't pay the extended warranty co. for the warranty I purchased.

    2. I too am in the same situation as you. We have a 5th wheel and are unable to get our tags. We also paid for extended warranty and a trident protection package that puts us out an additional 5 grand. Neither are of any use as they took the money and did nothing with it. Not sure where to go from here. I make phone calls and get no answers.

    3. We had warranty work that was never done. We wrote the the manufacturer and they said it was our problem. Took money for things they never delivered. They will probably go to Florida and set up again.

  17. It appears we are getting close to a critical mass for a class action suit. This possibility should certainly NOT supplement your ambitions to go it alone, as putting a class action together will take awhile. Also. despite what some people are saying, filling bankruptcy does not indemnify you of criminal wrong doing.

    I did manage to get my money back from my extended service warranty. Protected Portfolio from The Warranty Group is actually being really good about this. The paid me, even though McMahon's didn't turn in my agreement. I can only imagine they are taking McMahon's to court.

  19. McMahon's did not pay off our trade in or our extended warranty on the new trailer. We have filed a small claims action but the process server can't find anyone to serve it to.
    the address for the pres/ ceo is a pile of rubbish, condo has been torn down. I would be interested in class action suit if anyone knows of one.

  20. If there is a class action i want to be in it. We bought a 2014 palazzo and paid 9 grand for the extended warranty and 3 grand for the trident paint protectant that was never put on. Mcmahons only paid the warranty company 900 dollars. This has been the worst experience in buying an RV.

  21. If you are incline or pissed off enough you may want to file complaints to the following agencies. According to CA DMV Investigations they are looking into the business practices of McMahons Rv. For DMV to understand the magnitude of number of customers that have been taken by McMahon's RV they need your feedback.

    We need to apply pressure to McMahon's RV (Brent McMahon) to fulfill their (his) contractual obligations and include state and federal agencies to help us. I was originally optimistic that Camping World would be the night and shinning amour that would rescue all of us from these dark times, however recent information I have received from their customer service department they are not interested in purchasing this dealership at this time. I suggest we not wait for someone else but we now take action. I have filed complaints with the following state agencies. I will be filing a crime report with Westminister PD and a complaint with the Orange County DA in the next few days. I would ask that all of us contact local news agencies to see if one of them will take this on. Also, file a complaint with State Senator Dunn to see if he can assist in applying pressure to State enforcement agencies to assist us in our fight. Here is some contact information:

  22. When I purchased my motorhome (1/3/14) from McMahon's RV I purchased an extended service plan, which I paid for in full. Once I realized McMahon's was having financial problems I contacted Portfolio who was the service plan administer to ensure the premium was paid and the plan was active. Portfolio indicated they had no record that McMahon's sent in the premium and the policy was not active. In early May I called Portfolio again to see if anything had changed and they indicated McMahon still had not paid the premium, however they said they would honor the contract and would activate the policy. They asked that I send in a copy of the original contract and proof I had paid to McMahons the premium payment, which I did and they recently sent confirmation my policy was active.

    We too have been defrauded by McMahon's, on 3/11 we had purchase a 2007 motorhome , it was paid in full and promise to be deliver to us by 3/24. Every time we called we were inform that they were still working on details and repairs before delivery and to be patience. After the bank took over we had to go and insist on delivery. We received motorhome as is, no work was done still had sticker on window and was filthy. So far we have invested over $4500 and still not done. DMV paper work was never done. We have also been informed that we were over charge on our contract.

  27. Ok Guys I got the same thing. Supposed to deliver new coach, didn't happen....Never paid for forwarded contact or money to portfolio protection, took hold of my trade and started dmv process and never paid it off....sent new loan paperwork to B of W and started a new loan on a coach I do not own.......attempted emails, phone contacts,hundreds since 3/8/2014 So has anyone contacted a lawyer its time to pull this all together.

  29. We too have been defrauded by McMahon's. Traded in Motor Home for 5th wheel in Feb. 2014. Trade in not paid off. We are now making payments on both and are close to bankruptcy ourselves. $7,000 for extended warranty they never paid. Also $5,000 down payment in addition to Motor home. Attorney we contacted wanted $3,000 up front to even start. We just can't keep throwing money away but what choice do we have? Can't get the Motor Home back to sell it, can't keep making payments, our credit is going to be ruined. Need to find affordable attorney and would be interested in Class Action Suit also. I am 66 and my husband is 69. We did have plans for a nice retirement and Brent McMahon has just taken that away from us.

    Here's our situation...We traded in our travel trailer on a new 5th wheel at McMahon's RV Colton with the agreement that they would pay off the balance of $10,100 on our trade-in. That never happened and now we are stuck paying for that trailer that we do not have in our possession. Also we paid for extended service agreement and trident care package to the tune of $6000 in our purchase agreement. Trident refuses to care for our 5th wheel since they have not been paid by McMahon's, but after contacting the ESA company and FAXing them our paperwork, they have agreed to cover us even though they never were paid. We are in process of contacting a lawyer in consumer fraud, filing a case with the police department, and the DMV as well. Any suggestions will be greatly appreciated.

    1. It is doubtful that you will find an attorney willing to file a class action on a contingency since the liable party is bankrupt. And beware of the attorney who offers to take it on a you-pay basis.

  32. It is a chapter 11 which is a reorganization. Not a chapter 7 liquidation. File fraud claims to seek recourse. McMahons has assets, you just have to find them and when is facing jail time he will roll over.

    1. Anonymous from June 20......We have been given the run-a-round by a bunch of lawyers. Talked to one today who said no one can do anything as long as Bankruptcy has been filed. Our loan number for traded in RV (which was never paid off) is actually listed on the forms for the Bankruptcy. We are going to write letters to Bank, DMV, Attorney General, Police, and anyone else we can think of stating how fraudulent Brent McMahon/Mega RV Corp has been. Still trying to find an attorney to help us. Were told that until we receive a notice that the RV is involved in Bankruptcy proceedings no one will touch the case. That attorney refused to take the customary consultation fee because the State Bar Referral Service should never have sent us to him in the first place. Wonderful State of California that we all live in. No help for the consumers who are getting shafted here.

  33. I can not believe California justice system has not locked up this ======== up. I had the same problems as all of you have had. I have the motor home but had to pay for repairs they were to take care of. So far 8000.00 for repairs, 1300.00 to get a bonded title, and 4995.00 extended warranty they failed to purchase. Have contacted bbb ca. justice system, dmv to name a few. They all seen disinterestad in pursuing this rippoff artist. This should be a criminal case.

I purchased a 2000 33ft wilderness from McMahon RV in Arizona in Mar of 2014 for 8500.00 cash, then moved to Minnesota until recently my trailer was in a storage shed while I was recovering from back surgery. I never realized I didn't get a title. When I call Arizona DMV they said it was a purged record and I would need to get a bonded title. Which means the money I paid to McMahons RV for Tax, Title, and licensing was never submitted. Now I have to bring it back to Arizona for an inspection to get a bonded title. These people are definitely criminals.
